Law 404 - Enforcement of Money Judgments

Course Description

Enforcement of Money Judgments (Law 404) covers Saskatchewan’s modern system for the governance of judgment enforcement. It entails a detailed examination of The Enforcement of Money Judgments Act, which provides a code of law for the enforcement of money judgments. This is supplemented by an examination circumstances in which non-Saskatchewan and non-Canadian judgments may be enforced against assets located in Saskatchewan. Another aspect of judgment enforcement is the law dealing with fraudulent conveyances and preferences. A significant portion of the course is devoted to this complex area of the law, which may soon be subject to legislative reform in Saskatchewan.
